and it dont apply to deer either 'body of the deer act ' i believe only an authorised person shal remove when dead the body of the deer from any byway or highway as defined by law,and the list of authorised persons dont cover luck buggers.....

its a myth that if you knock a bird over you cant pick it up. a mate of mine who is a copper said that he checked the law on this and said that as long as you dont swerve to hit an animal (who would do that ) there is nothing stopping you in picking it up. unless a deer has been clean killed i dont think i would want it because it would be full of testocerone which taints the meat. |

Unfortunatly Adam that loophole is covered by the law.
If as a motorist you "accidentally" run over some game/rabbits you arent allowed to pick it up,anyone following you in another veichle can though.
The barstewards would bottle fresh air if they could. |
Tis all down to the old common law, you could "accidentally" shoot a bunny or pheasant in the next field, it only becomes poaching when you pick them up and attempt to leave with them or bury them for later collection....there are lovely little loopholes in the law. If you run it over then pick it up you can be seen to have used your weapon (vehicle) to obtain the bird by tort/crime (it can be classed as both) of poaching...as i say ill have to refresh my memory and post the sources. _________________ If you act like a dumbsh*t, they'll treat you as an equal! |

My mates Transit van is good on fur & feather not very soft mouthed thou, at present he s training it to jump fences & gates instead of ploughing through them and he is also thinking about putting it over a scoobie it should make an interesting cross . _________________ Life is a bowl of all bran you wake up every morning and it is there

i think you would certainly be guilty of an offence if you got caught deliberately swerving to hit something but the only time you could possibly get done for poaching is if you pick up a deer from the roadside because it technically belongs to the landowner on the stretch of road it was killed. The only time you could get done for picking up other game off the road is if you stop on a blind bend and maybe cause an accident. |
